1. Definitions
"These Terms & Conditions govern the photography and related services provided by Chait Photography (“The Photographer”, “we”, “us”, or “our”) to any individual, body of persons, firm, company, organization, or other entity (“The Client”, “you”, or “your”). “The Photographer” includes Chait Photography and its photographers, videographers, editors, assistants, freelancers, and authorized representatives. “The Services” means photography, videography, editing, album design, printing, consultation, or any other related services agreed upon between the Photographer and the Client. “The Event” means any wedding, engagement, maternity shoot, pre-wedding shoot, baby shoot, ids shoot, corporate event, product shoot, portrait session, or other assignment for which the Photographer has been booked. By making a booking, paying an advance, confirming an assignment, or otherwise engaging our Services, the Client acknowledges that they have read, understood, and agreed to these following Terms & Conditions.
2. Acceptance of Terms & Conditions
All contracts, bookings, quotations, and transactions between the Photographer and the Client, whether made orally, through email, WhatsApp, social media, quotation, invoice, booking form, or in writing, are subject to these Terms & Conditions and shall be deemed to be incorporated into any contract between the Photographer and the Client. A booking shall be considered confirmed only after the required advance payment has been received and acknowledged by the Photographer.
The Photographer may accept assignments at locations within Bangalore city limits, subject to availability. For locations outside Bangalore, the applicable travel costs of the photography crew, including transportation, tolls, parking, accommodation, food, permits, and other reasonable travel-related expenses, shall be borne by the Client unless otherwise agreed in writing.
3. Booking & Date Reservation
Photography dates are reserved exclusively for the Client only after receipt of the agreed booking advance. A tentative enquiry, quotation, verbal discussion, or date enquiry does not guarantee availability or reservation of the date. Once a date has been confirmed, the Photographer may decline other assignments for the same date. Accordingly, the booking advance shall generally be non-refundable, subject to the cancellation terms stated in these Terms & Conditions.
4. Photography Packages & Scope of Services
The exact services included in the Client's package shall be as specified in the quotation, invoice, proposal, or booking confirmation. Any service not specifically included in the agreed package shall be treated as an additional service and may incur additional charges. Additional photography hours, additional photographers, additional locations, additional edited photographs, albums, prints, drone photography, travel, accommodation, special equipment, or other services may be charged separately.
5. Advance & Payment Terms
An advance payment of 50% of the agreed amount shall be made to block and reserve the Photographer's dates and services exclusively for the Client, unless a different payment schedule has been agreed in writing. The remaining 50% shall be payable upon completion of the assignment or before final delivery of the photographs, as specified in the quotation or invoice.
The Photographer reserves the right to withhold final photographs, albums, videos, prints, or other deliverables until all outstanding payments have been received. Payments may be made through bank transfer, UPI, online transfer, or other payment methods accepted by the Photographer.
6. Cancellation Fees
If a booking is cancelled by the Client more than ten working days before the scheduled assignment, the Photographer may charge up to 50% of the agreed fee. If a booking is cancelled within ten working days of the scheduled assignment, the booking advance may be forfeited. If a booking is cancelled within one working day of the scheduled starting time, the Photographer reserves the right to charge up to 100% of the agreed assignment fee.
Any refund, if applicable, shall be processed after deducting applicable cancellation charges, expenses already incurred, and any non-refundable third-party costs.
7. Rescheduling
Requests to reschedule an assignment should be made as early as reasonably possible. Rescheduling is subject to the Photographer's availability and is not guaranteed. If the Photographer is available on the proposed new date, the booking may be transferred to that date, subject to any applicable additional charges. If the Photographer is unavailable on the requested new date, the rescheduling request may be treated as a cancellation.
8. Cancellation or Inability to Perform by the Photographer
In the unlikely event that the Photographer is unable to perform the assignment due to serious illness, accident, emergency, or other circumstances beyond reasonable control, the Photographer may attempt to provide a suitable replacement professional, subject to availability and Client approval. If no suitable replacement can be arranged, the Photographer's liability shall generally be limited to refunding payments actually received for the unperformed portion of the Services.
9. Copyright & Ownership
In accordance with applicable Indian copyright law, including the Copyright Act, 1957, as amended from time to time, the copyright and intellectual property rights of all images, videos, creative works, compositions, and other material created by the Photographer shall remain the property of the Photographer unless expressly transferred to the Client through a separate written agreement.
Unless the Photographer gives written authorization, the Client shall not sell, license, commercially reproduce, substantially alter, or commercially distribute any images created by the Photographer. Payment for photography services does not automatically constitute a transfer of copyright or intellectual property rights.
The Client may use the final delivered photographs for personal, non-commercial purposes, subject to the terms of the agreed package. All photographic reprints, digital duplications, commercial reproductions, or copies made from images created by the Photographer shall only be carried out with the Photographer's permission where required.
10. Portfolio & Promotional Usage
Being professional photographers, our business works substantially on the basis of the quality of work we have done in the past. The Photographer may therefore use selected photographs and/or video footage from the Client's event for portfolio purposes, including display on the Photographer's website, social media pages, photography portals, advertisements, exhibitions, competitions, brochures, and other promotional materials.
If the Client has a genuine requirement that photographs or videos not be used for promotional purposes, the Client must communicate this requirement to the Photographer in writing before the assignment, and such restriction should be mutually agreed upon in writing.
11. Client Permissions & Guest Consent
The Client is responsible for informing relevant participants, guests, family members, employees, models, or other individuals that photography and/or videography will take place at the Event where appropriate. The Client shall obtain any necessary permissions or consents required for photography, videography, use of images, venue access, and participation of minors or other individuals where applicable.
12. Privacy & Personal Data
The Photographer may collect and process personal information necessary to provide the Services, including names, contact details, event details, venue information, payment information, and photographs. Such information shall be handled in accordance with applicable Indian privacy and data-protection laws. The Photographer will take reasonable measures to protect Client information but cannot guarantee absolute security of digital systems, cloud storage, email, messaging platforms, or other third-party services.
13. Image Selection & Editing
The Photographer shall have creative discretion over the selection, composition, colour grading, editing, retouching, cropping, and artistic treatment of photographs unless a specific editing style has been agreed upon in writing. The Photographer shall not be required to provide every photograph taken during an assignment.
RAW files and unedited photographs are generally not included in the final delivery unless specifically agreed in writing. The Photographer's artistic style and editing approach form an important part of the Services.
14. Image Delivery
The Photographer shall endeavour to deliver the final photographs within approximately two to three weeks after the assignment, unless a different delivery period has been agreed in writing. Large events, weddings, extensive editing requirements, album design, holidays, unforeseen technical issues, or other circumstances may result in a longer delivery period.
Where albums, videos, prints, or other physical products are included, delivery times may vary depending on third-party printing, production, and shipping timelines.
15. Images/Data Supplied in Electronic Format
For all images and data supplied to the Client in electronic format, including but not limited to email, online galleries, cloud storage, download links, CDs, DVDs, USB drives, and other digital media, the Photographer shall take reasonable steps to ensure that the supplied data is usable and free from known viruses or corruption at the time of delivery.
The Client agrees to take similar reasonable steps to ensure that any data, files, documents, or other materials sent to the Photographer are not corrupt and/or infected with viruses or malware. The Photographer shall not be held responsible for any damage, disruption, loss, or corruption caused to the Client's computer, device, software, or data as a result of using supplied digital media or files.
16. Image Storage & Backup
The Client is responsible for downloading and safely backing up all delivered photographs and other digital files. The Photographer recommends that Clients maintain at least two independent backups of all important photographs. The Photographer may retain copies of photographs for archival and business purposes but does not guarantee permanent storage of the Client's files.
17. Venue Restrictions & Permissions
The Client is responsible for obtaining any permissions required from venues, hotels, event organizers, religious institutions, residential communities, property owners, authorities, or other relevant parties. The Photographer shall not be responsible for restrictions imposed by a venue or authority that prevent or limit photography or videography.
If a venue prohibits flash photography, tripods, drones, lighting equipment, movement, or particular types of photography, the Photographer shall comply with such restrictions.
18. Drone Photography
Drone photography or videography, where offered, is subject to weather conditions, location restrictions, venue permission, applicable aviation regulations, government requirements, and operator availability. The Photographer reserves the right to cancel or modify drone operations where flying would be unsafe, prohibited, or legally restricted.
19. Travel & Outstation Assignments
For assignments outside Bangalore, the Client shall bear applicable travel expenses, transportation, accommodation, food, local transportation, tolls, parking, permits, and other reasonable outstation expenses unless otherwise agreed in writing. For destinations requiring air travel or overnight accommodation, such arrangements shall be agreed upon before the booking is confirmed.
20. Additional Hours / Overtime
The agreed package shall cover only the number of hours specified in the quotation or booking confirmation. If the Client requests the Photographer to continue beyond the agreed coverage period, additional hourly charges may apply. Additional coverage shall be subject to the Photographer and crew's availability.
21. Rush Services
The Photographer reserves the right to make an additional charge if the Client requests rush editing, expedited delivery, urgent album production, or any other service within a shorter-than-standard timeframe. Rush services are subject to availability and cannot be guaranteed.
22. Client Cooperation & Responsibilities
The Client agrees to provide accurate information regarding the event date, timings, venue, location, expected number of guests, required coverage, special photography requirements, travel requirements, contact details, schedule, and important ceremonies. The Client shall provide reasonable access to the venue and necessary areas for the Photographer and crew to perform their work.
23. Event Schedule & Delays
The Photographer shall make reasonable efforts to follow the schedule provided by the Client. Delays caused by the Client, guests, venue, late arrival, delayed ceremonies, changes to the event schedule, traffic, or other circumstances outside the Photographer's control may affect the amount of coverage available.
The Photographer shall not be required to extend coverage without additional payment where delays result in the assignment exceeding the agreed coverage period.
24. Conduct
The Client shall be responsible for the behaviour of any persons accompanying them to an assignment. The Photographer reserves the right to suspend or terminate an assignment without notice if the Photographer or crew is subjected to abusive, threatening, discriminatory, unsafe, illegal, or excessively disruptive behaviour.
In such circumstances, the Photographer reserves the right to charge the full agreed fees and expenses. The Client shall fully reimburse the Photographer or the Photographer's agents for any loss or damage caused to property, equipment, or other assets through intentional or negligent actions of the Client or persons under the Client's responsibility.
25. Equipment Failure
The Photographer shall take reasonable precautions to maintain and operate professional photography equipment. In the unlikely event of equipment failure, the Photographer will make reasonable efforts to use backup equipment or alternative methods where available. The Photographer shall not be liable for circumstances beyond reasonable control where equipment failure results in partial or complete loss of coverage.
26. Loss or Corruption of Images
The Photographer shall take reasonable precautions, including appropriate equipment and data-handling practices, to minimize the risk of image loss. However, in the unlikely event of loss, corruption, theft, technical failure, accidental deletion, or other destruction of photographs, the Photographer's liability shall, to the maximum extent permitted by applicable law, be limited to the amount actually paid by the Client for the affected Services.
27. Force Majeure
The Photographer shall not be liable for failure or delay in performing the Services due to circumstances beyond reasonable control, including but not limited to natural disasters, floods, severe weather, fire, accidents, epidemics, pandemics, government restrictions, strikes, civil unrest, war, terrorism, transportation disruption, venue closure, power failures, serious illness, medical emergencies, or other unforeseen circumstances beyond reasonable control.
28. Creative Style & Client Expectations
The Client acknowledges that photography involves artistic judgment and creative interpretation. The Photographer's portfolio represents the general style and quality of work but does not guarantee that every photograph will have an identical appearance. Differences in lighting, weather, venue conditions, clothing, skin tones, décor, crowd size, location restrictions, and other circumstances may affect the final appearance of photographs.
29. Re-Editing & Retouching Requests
Reasonable correction requests may be considered where technically possible. Extensive retouching, object removal, body modification, background replacement, manipulation, or other specialized editing requested after delivery may incur additional charges. The Photographer reserves the right to determine whether a requested alteration is technically feasible and consistent with the agreed service.
30. Prints, Albums & Physical Products
Where physical albums, prints, frames, photobooks, or other products are ordered, production will begin after Client approval of the final design where applicable. Once an album or physical product has been approved for printing, changes requested thereafter may result in additional charges.
Printing and colour reproduction may vary slightly from digital previews due to differences between screens, printing equipment, paper, ink, and production processes.
31. Third-Party Services
The Photographer may work with or engage third-party service providers for printing, album production, cloud storage, delivery, equipment rental, or other services. The Photographer shall not be responsible for delays or failures caused by independent third-party service providers, although reasonable efforts may be made to resolve such issues.
32. Price & Terms
The Photographer reserves the right to amend prices, packages, service offerings, and these Terms & Conditions for future bookings without prior notice. The price applicable to an already confirmed booking shall generally remain as agreed in the applicable quotation or invoice unless additional services or Client-requested changes are subsequently added.
33. Taxes & Government Charges
All applicable taxes and statutory charges shall be charged in accordance with applicable Indian law. Where applicable, GST or other government-imposed charges may be added to the quoted price.
34. Commission Payments
Any commission, stand fee, participation fee, or similar payment agreed in advance shall be based upon the numbers, bookings, or other information provided by the Client. The Photographer reserves the right to reduce any such payment on a pro-rata basis if the number of attendees, bookings, participants, or other agreed parameters are reduced. Unless otherwise agreed in writing, any such payment shall not become due until after the relevant event or assignment has taken place.
35. Limitation of Liability
To the maximum extent permitted by applicable law, the Photographer shall not be liable for indirect, incidental, special, consequential, or emotional losses arising from the Services. Where liability cannot legally be excluded, the Photographer's liability shall, to the extent legally permitted, be limited to the amount actually paid by the Client for the specific Services giving rise to the claim.
36. Complaints & Disputes
Any complaint regarding the Services should be communicated to the Photographer as soon as reasonably possible and preferably within seven days of delivery of the relevant Services. The Client and Photographer shall attempt to resolve any dispute amicably through good-faith discussion before initiating legal proceedings.
37. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of India. Subject to applicable law, courts having appropriate jurisdiction in Bengaluru, Karnataka, India shall have jurisdiction over disputes arising from these Terms & Conditions or the Services.
38. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to remain valid and enforceable to the maximum extent permitted by law.
39. Entire Agreement
The quotation, invoice, booking confirmation, agreed package, and these Terms & Conditions together constitute the understanding between the Photographer and the Client regarding the Services. Any amendment, special arrangement, discount, additional service, or exception should preferably be confirmed in writing.
In case of any conflict between these Terms & Conditions and a specific written agreement or quotation issued for an assignment, the specific written agreement or quotation shall prevail to the extent of the conflict.
